Considerations in the Drafting of Prenuptial Agreements
Under Colorado law, prenuptial agreements are valid, provided that certain conditions are met:
Complete disclosure of assets — all of the separate assets and debts of both parties must be disclosed.
Adequate time before the marriage — a prenuptial agreement is not a last minute item. The more time that the lawyers for the parties and the parties themselves have, the stronger and better the agreement will be.
No coercion — the parties must enter into the agreement of their own free will.
A postnuptial agreement cannot be concluded in contemplation of divorce.
