Paternity, Child Custody Visitation
Colorado law draws a distinction between biological fatherhood and legal fatherhood. In all custody and visitation matters, courts hold one principal paramount over all of the rest — what it determines to be the "best interest of the child".
In deciding whether to grant visitation rights to a biological father, the Court will usually give some weight to the prior relationship of the father and the child. The fact that a man has not previously had a relationship with a child is not necessarily a barrier to obtaining father's rights, though it may make it more difficult.
