Child Custody & Visitation

Colorado Child Custody Attorney

Serving Families and Individuals in Colorado and the Denver-Metro Area

Parents naturally place a very high importance on the well-being of their children. The state of Colorado concurs and has statutes that emphasize the importance of considering the best interests of children in determining child custody, visitation and financial support.

At Carolyn Moller Duncan, P.C., we advise our family law clients accordingly, and help them understand the law and their legal options. We work to protect their rights and achieve custody and visitation solutions that are in the best interests of their children.

We advise and represent clients in matters involving:

  • Child custody
  • Visitation rights and parenting plans
  • Modifications in custody and visitation
  • Parental relocations and move-aways
  • Paternity as it relates to visitation

Advocating in the Children’s Best Interest

Whenever possible, courts in Colorado favor joint custody solutions that grant both parents a say in how a child is raised. In this type of arrangement, the parents share decisions regarding health, education, religion and other life issues. The child may live primarily with one parent, while the other is granted visitation rights. Other solutions are possible however, including sole legal and physical custody.

Carolyn Moller Duncan, P.C. will advise you of your legal options and the likely outcomes of those options. Working together, we will determine your desired custody and visitation goals, and then our firm will seek to achieve those goals on your behalf.

Child Custody As It Affects Child Support

The amount of child support to be paid by one spouse to another may depend on the number of overnights the child will spend with each parent. Many divorcing parents know that if the children spend between 93 and 182 nights per year with the parent who is paying child support, the amount of support owed to the other parent will be lower. However, it is important to recognize that there is still a range — the closer you spend to 182 overnights per year with your children, the more expense you will incur and the less child support you will be expected to pay.

These considerations may influence your decisions regarding child custody arrangements. We can discuss these matters and help you come to the decision that is right for you and your children.
